Section 1: Scope
These are the terms and conditions on which we supply products to you in the United Kingdom (“Terms and Conditions”). Please read these Terms and Conditions carefully before you submit your order to us. We amend these Terms and Conditions from time to time. Every time you wish to use our site, please check these Terms and Conditions to ensure you understand the terms that apply at that time.
Section 2: Conclusion of contract
The display of products in the online shop does not constitute a legally binding offer; it is a non-binding online catalogue only. The products you have selected by pressing the “Add to basket” button are summarised again for you in an order overview at the end of the order process. Here you can review the various information provided during the order process and add to or correct it by clicking the “Change” button. By clicking the button “Buy now”, you send your order details and make a binding declaration to LUMAS that you want to purchase the products listed there. We automatically accept your offer upon receipt of your order. Directly after sending the order, you will receive an email with an order and contract conformation, in which the details of your order are listed again.
Section 3: Cancellation
Please note that artworks with custom mounting/framing (“select a custom presentation”) as well as unmounted/unframed photo prints are excluded from the right to cancellation/withdrawal, as they are custom-produced to your individual specifications. Custom products are excluded from the right to cancel according to Section 312, Paragraph 2, No. 1 of the German civil code.
We point out that there is no right of withdrawal for digital works ("NFTs"). The consumer hereby expressly agrees that LUMAS may commence performance of the contract prior to the expiry of the withdrawal period and confirms his knowledge of the fact that his right of withdrawal expires upon commencement of performance of the contract.
You have the following rights of cancellation for online orders of products:

You have the right to cancel this contract without reason within 30 days after the day you (or someone you nominate) receives the products, unless:
A) your products are split into several deliveries over different days – in this case you have until 30 days after the day you (or someone you nominate) receives the last delivery to change your mind about the products;
or
B) your products are for regular delivery over a set period – in this case you have until 30 days after the day you (or someone you nominate) receives the first delivery of the goods.
This right does not apply to “Custom Finish” or made to measure products. - You may have the right to cancel this contract if what you have bought is faulty or misdescribed (see Section 11).
- You have the right to cancel this contract if we have delivered the products late.
- You have the right to cancel this contract where we change the terms of the contract.
- In all other cases (if we are not at fault and there is no right to change your mind), you can still end the contract before it is completed, but you may have to pay us compensation. The contract will end immediately and we will refund any sums paid by you for products not provided but we may deduct from that refund (or, if you have not made an advance payment, charge you) reasonable compensation for the net costs we will incur as a result of your ending the contract.
To exercise your right to cancel, you must inform us (AVENSO UK Ltd., 21 - 23 Earlham Street, Seven Dials, Covent Garden, London WC2H 9LL, Tel.: +44 20 3608 7590 , E-MAIL ) of your decision to cancel in a clear, written statement (by letter or e-mail, for instance).
The deadline for the right to cancel will be met as long as your statement indicating you will be exercising the right to cancel is sent within the allotted cancellation period.
Cancellation Terms and Process
Should you cancel the contract, we will refund all payments received from you, including shipping costs (with the exception of additional costs from selecting a different type of delivery than the standard, cost-effective shipping we offer) promptly. If you are exercising your right to change your mind then:
A. if we have not offered to collect the products, your refund will be made within 30 days from the day on which we have received the product back from you or until you have provided proof of their return shipment, whichever comes first; or
B. in all other cases, your refund will be made within 30 days of you telling us you have changed your mind.
If you end the contract for any reason after the products have been dispatched to you or you have received them, you must return them to us in the original packaging. If you are exercising your rights to change your mind, you must send the products off within 30 days of the date you inform us of the cancellation. This deadline will be met as long as you post the goods to us within this 30-day period.
We shall bear the costs for returning products if the products are faulty or misdescribed, if you are ending the contract because we have told you of an upcoming change to the product or these terms, a delay in delivery due to events outside of our control or because you have a legal right to do so as a result of something we have done wrong.
In all other circumstances (including where you have exercised your right to change your mind), you shall bear the direct costs for returning products. We may make deductions from the price of the products when refunding you, if you are exercising your right to change your mind. We may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the product if this has been caused by your improper handling of the products.
You do not have the right to change your mind in respect of any “Custom Finish” or made to measure products selected by you, as these products are produced to your individual specifications. You are responsible for ensuring that these specifications are correct.
Section 4: Delivery
Unless agreed otherwise, delivery will be to your address or to the delivery address specified by you. The delivery time is approx. 10 workdays.
Section 5: Edition Certificate with signature
For organisational reasons, LUMAS may also send the orderer the Edition Certificate with the artist’s signature and the edition details separately – and subject to a delay. In this case, the cancellation period shall only start after receipt of the Editions Certificate with signature. If you exercise your right of cancellation, you must also immediately return the unused Edition Certificate. The purchase price shall not be refunded without receipt of Edition Certificate. The right of cancellation shall lapse if the Edition Certificate is used on the work of art, the frame, the lamination or elsewhere.
Section 6: Prices, due date and payment, default
The price of the products is stated online and includes VAT. Shipping costs are not included in the price and will be charged in addition to the price in each case. Information about shipping costs is contained in Section 7 of these Terms and Conditions.

In case of a PayPal or RatePAY payment you will be automatically redirected to the payment services PayPal or RatePAY after completing the order process. The process of payment is then governed by the terms of PayPal/RatePAY.
The buyer pays the sale price by credit card, by debit, upon making the order (pre-payment). When paying via PayPal or RatePAY the buyer pays after delivery.
If you do not make any payment to us by the due date we may charge interest to you on the overdue amount of 3% a year above the base rate per annum published by the Bank of England and may charge companies 9% above the respective base rate per annum published by the Bank of England. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.
Section 7: Shipping costs
For deliveries inside the EU, LUMAS applies the following shipping rates, which include our secure specialty packaging and insurance:

When ordering online, please select the country of the desired shipping destination; the correct shipping costs will then be shown.
Orders with items of different sizes will be shipped at the rate of the largest picture in the order. Books are shipped free of charge. If, for logistics reasons, LUMAS splits the order across multiple shipments, you shall not incur additional costs for this.
Section 8: Offsetting, retention
You may set off any liability of LUMAS against any liability of you to LUMAS.
Section 9: Retention of title
Until full and final payment, the delivered products shall remain the property of LUMAS.
Section 10: Liability
If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking this contract or our failing to use reasonable skill and care. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability:
(a) for death or personal injury due to our negligence or the negligence of our employees, agents or subcontractors; and
(b) for breach of your legal rights in relation to the products, including the right to receive products which are as described and match information we provided to you and any sample or model seen or examined by you, of satisfactory quality, fit for any particular purpose made known to us, supplied with reasonable skill and care, and for defective products under the Consumer Protection Act 1987.
We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
The above provisions shall apply accordingly to the liability of LUMAS in respect of reimbursing futile costs.
Section 11: Warranty
The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:
(a) up to 30 days: if your products are faulty, you can get a refund.
(b) up to 6 months: if your products can’t be repaired or replaced, then you’re entitled to a full refund, in most cases.
(c) up to 6 years: if your products do not last a reasonable length of time you may be entitled to some money back.
Please check the products after delivery at the earliest opportunity and take prompt action if defects are discovered.
Section 12: No granting of rights
By buying a photographic print, you are only acquiring material ownership of the print. No other rights are granted or implied. Any reproduction (copying), dissemination, leasing, public exhibition or other analogue or digital use is not permitted unless authorised by law. However, you can resell the print.
Section 13: Collecting, processing and using personal data
All provisions regarding the protection of your data can be found at the LUMAS privacy policy.
Section 14: Applicable law
These Terms and Conditions are governed by English law and you can bring legal proceedings in respect of the goods in the English courts. If you live in Scotland you can bring legal proceedings in respect of the goods in either the Scottish or English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the goods in either the Northern Irish or the English courts.
